Eligibility: Open only to legal residents of the 50 United States and the District of Columbia who are at least 18 years old or the age of majority in their state of residence, whichever is older. Employees of Topic (“Sponsor”) and of its parents, subsidiaries, and affiliates and of any third parties involved in the development or administration of this Sweepstakes (collectively, the “Sweepstakes Entities”), as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to participate in Topic’s Criminally Good Sweepstakes (the “Sweepstakes”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Void where prohibited.
Timing: The Sweepstakes begins at noon Pacific Time (“PT”), April 29, 2022, and ends at 1:30 PM PT, May 1, 2022 (the “Sweepstakes Period”).
How to Enter: There are two ways to enter, and both entry methods will be available when you visit the Topic booth at 2022 CrimeCon Las Vegas during the Sweepstakes Period. First, you may enter by signing up for the free Topic email newsletter. To do so, provide your first name and email address on the Google Docs form that will be available on an iPad or computer at the booth. When you sign up for the Topic newsletter, you will receive an entry in the sweepstakes and also an opportunity to play the prize wheel at the booth. One of the prize wheel prizes is an additional entry in the Sweepstakes. Limit one entry per person unless the entrant receives another entry or two via the prize wheel. Entries that exceed the limit will be void, if discovered by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification if discovered by Sponsor. Sponsor reserves the right in its sole discretion to disqualify any entry at any time that in Sponsor’s opinion does not comply with these Official Rules. Incomplete entries will be disqualified. Sponsor is not responsible for entries that are lost, late, stolen, garbled, damaged, misdelivered, or misdirected. All received entries become the property of Sponsor and will not be returned.
Winner Selection, Notification, and Verification: After the close of the Sweepstakes Period, winners will be selected by random drawing from among all eligible entries. Odds of winning depend on the number of eligible entries. Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Sponsor will attempt to contact winners by email. Each potential winner may be required to sign and return to Sponsor an affidavit of eligibility and liability/publicity (except where prohibited) release and provide requested identification in order to claim his/her prize. Winner may also be required to complete and return an IRS Form W-9. Any required documents must be signed and returned within five business days of winner notification. If a potential winner does not respond within 72 hours after the first attempt to contact potential winner, if a potential winner fails to sign and return required documents and provide required identification by the deadlines set by Sponsor, if a potential winner is not in compliance with the Official Rules (including eligibility requirements), or if a potential winner declines the prize, Sponsor may select an alternate winner for the prize by random drawing from remaining eligible entries, time permitting.
Prizes: There are two first prizes. Each first prize consists of the following: two Gold VIP Tickets to CrimeCon 2023 and a one-year subscription to Topic. The approximate retail value (“ARV”) of each first prize is: $859. If first prize winner does not wish to attend, CrimeCon 2023, winner may select a Yeti Hopper Flip 12 Soft Cooler. ARV: $250. Winner must notify Sponsor within one week of winner notification whether winner is choosing alternate prize. There are 10 second prizes. Each second prize is a one-year subscription to Topic. The ARV of each second prize is $60. The total ARV of all prizes is up to $2,318. Prizes are nontransferable, and there are no substitutions except at the discretion of Sponsor. Sponsor not responsible for loss, delay, or damage in delivery of prizes. All expenses not expressly provided for herein will be the sole responsibility of winners, including but not limited to any government taxes. All properly claimed prizes will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.
Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to allow each of the Sweepstakes Entities to use each winner’s name, likeness, voice, opinions, biographical information, hometown, and state for promotional purposes in connection with the Sweepstakes only, in any media worldwide without further payment or consideration. (TN residents need not so consent.)
General Conditions: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. If there is any conflict between any term of these Official Rules and any of the entry or marketing materials used in connection with the Sweepstakes, the terms of the Official Rules will govern. If for any reason, this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause that corrupts or threatens the administration, security or integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to terminate or suspend the Sweepstakes. If Sponsor terminates the Sweepstakes, it will determine the winner by random drawing from among all eligible, non-suspect entries received as of the termination of the Sweepstakes, if it is possible to do so. If Sponsor terminates or modifies the Sweepstakes, Sponsor will post notice at the Topic booth.
Release: By entering this Sweepstakes, entrant agrees to release and hold harmless each of the Sweepstakes Entities and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action including, without limitation, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of the prize.
Limitations of Liability: The Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants or printing errors; (ii) unauthorized human intervention in any part of the entry process of the Sweepstakes; (iii) technical or human error that may occur in the administration of the Sweepstakes or the processing of entries; or (iv) lost, late, incomplete, invalid, unintelligible, or misdirected entries. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry because of discontinuance of the Sweepstakes, or any part of it, for any reason.
Disputes: Entrant agrees that: (i) all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the prizes awarded must be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in the County of New York, New York; (ii) all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
Winners List: To receive the names of the winners, send a stamped, self-addressed envelope to Topic’s Criminally Good Sweepstakes Winners List, Topic, 114 Fifth Avenue, New York, NY 10011. Requests for the winners list must be received within 60 days of the end of the Sweepstakes Period.
